ملخص:
ضرب سيدنا عمر رضي الله عنه المثل العالي في الاجتهاد بجمعه لكل معاني فقه الدين، وإحاطته بالشرع ومعرفة مقاصد الشريعة على كمالها والطرق والوسائل لتحقيقها، وعمق نظره في النصوص مع إحاطة تامّة بواقع الناس وأحوالهم. ومن هذه دعائم أُسست عليها اجتهادات عمر رضي الله عنه وفقهه.
من القضايا التي تبيّن فهم سيدنا عمر للنصوص وللواقع قضية حاول هذا المقال دراستها وتحليلها وهي قضية المؤلفة قلوبهم. أشاد العلماء بفقه سيدنا عمر للنص في هذه القضية، وظنّ بعض المعاصرين أن عمر رضي الله عنه عطّل نصا لاقتضاء المصلحة.
إلا أني رأيت في هذه المسألة ما يشاد به من ضبط وإدراك للواقع أكثر مما يشاد من ضبطه للنصوص. وما ينقص فقه الواقع من فقه النص شيئا، وما يتضاربان. فآية المؤلفة قلوبهم ارتفع مناطها، فلم يبق صنف يعَـزّ الإسلام إن أعطاه، أو لا يأمن إن منعه.
Abstract:
Our Master Omar, may God be pleased with him, set a high standard in ijtihad by encompassing all aspects of religious jurisprudence, having a comprehensive understanding of Sharia, knowing the objectives of Islamic law in their entirety, and identifying the methods and means to achieve them. His deep insight into the texts was coupled with a thorough understanding of the realities and conditions of the people. These are the foundations upon which Umar’s ijtihad and jurisprudence were established.
One issue that illustrates Omar’s understanding of both the texts and the realities is the matter of those whose hearts are to be reconciled, which this article attempts to study and analyze. Scholars have praised Umar’s jurisprudence in this matter, while some contemporaries have mistakenly believed that Umar disregarded a text for the sake of expediency.
However, in this matter, I observed a commendable understanding and awareness of the realities more than a strict adherence to the texts. This does not detract from the jurisprudence of the texts, nor are they in conflict. The rationale behind the verse concerning those whose hearts are to be reconciled no longer applies, as there is no longer a category of people who would strengthen Islam if given, or pose a threat if deprived.
