الملخص:
تبحث هذه الدراسة في الموازنة بين الردع الجنائي والضمانات الدستورية في العراق، عبر تقييم “الإخصاء” (الكيميائي والجراحي) كخيار لمواجهة جرائم الاغتصاب، تتمحور الإشكالية حول مدى مشروعية هذا التدبير في ظل دستور 2005، الذي يكفل الحق في السلامة الجسدية ويحظر المعاملة غير الإنسانية.
بمنهج تحليلي مقارن، يستعرض البحث الطبيعة القانونية للإخصاء ومدى مواءمته للمواثيق الدولية والسياسة العقابية الحديثة. ونظراً لخلو التشريع العراقي من نص صريح، يناقش البحث فرص تبني الإخصاء الكيميائي “كبديل عقابي” ضمن ضوابط دقيقة. تنتهي الدراسة باقتراح نموذج تشريعي متوازن يحقق الحماية المجتمعية دون إهدار الكرامة الإنسانية، مع طرح بدائل احترازية أكثر انسجاماً مع مبدأ التناسب.

Abstract
This research examines the balance between criminal deterrence and human rights within Iraqi legislation, specifically evaluating “chemical and surgical castration” as a proposed measure to combat rape crimes. The study addresses a central question: to what extent can such measures be integrated into the Iraqi legal system without violating the 2005 Constitution, which guarantees human dignity, bodily integrity, and the prohibition of cruel or inhuman punishment
Utilizing a comparative analytical approach, the research explores the legal nature of castration and its position within modern criminal policy and international human rights conventions. Given the absence of explicit provisions in current Iraqi law, the study discusses the possibility of legislative adoption under strict controls, drawing on international experiences. The research concludes by emphasizing the need for a balanced legislative approach that ensures social protection and effective deterrence while upholding fundamental freedoms, suggesting alternative precautionary measures consistent with criminal justice principles.
