الملخص:
الدفاع الاجتماعي اتجاه فكري جديد يرسم سياسة جنائية على أسس حديثة، ويدخل في سبيل ذلك تغييرات جوهرية على مبادئ ونظم جنائية مستقرة، فتوجه النظم ومعايير القانون الجزائي نحو تكييف الجانح أدبياً واجتماعياً وبغير ضرورة لازمة تدفع لطرح السمات التقليدية للقانون الجزائي، ويستتبع ذلك عدم طرح مفهوم العقوبة. فالدفاع الاجتماعي وفقاً لذلك هو حركة إصلاحية تتجه إلى إرساء سياسة جنائية تتصف بنزعة إنسانية واضحة، وتولي الاهتمام الأول في فلسفته للإنسان، فتصون كرامته الإنسانية، وتعمل على تأهيله، وتكيفه مع المجتمع، وإعادته إلى الطريق السوي. وعلى هذا فإذا كان قانون العقوبات الحالي ينظر إلى الوراء، أي إلى الجريمة التي ارتكبت في الماضي، ليقدرها ويختار لمرتكبها العقوبة التي يراها عادلة، فإن الدفاع الاجتماعي ينظر إلى المستقبل، أي إلى إعادة تأهيل الفاعل ودمجه عضواً سليماً في مجتمعه، وذلك عن طريق عمل اجتماعي يكون هدفه الوقاية من الجريمة وحسن اختيار تدابير إصلاح الفاعل وتأهيله.

Summary
Social defense is a new intellectual trend that formulates criminal policy based on modern foundations, introducing fundamental changes to established criminal principles and systems. The systems and standards of criminal law are directed toward morally and socially conditioning the offender, without any apparent necessity, which leads to the abandonment of the traditional features of criminal law. This entails the abandonment of the concept of punishment. Accordingly, social defense is a reform movement aimed at establishing a criminal policy characterized by a clear humanitarian tendency, giving priority in its philosophy to the human being, preserving their human dignity, working to rehabilitate them, adapt them to society, and return them to the right path. Therefore, while current penal law looks back—that is, to the crime committed in the past, assessing it and choosing the punishment it deems just for the perpetrator—social defense looks to the future—that is, to rehabilitating the offender and integrating them as a healthy member of society. This is achieved through social work whose goal is crime prevention and the proper selection of reform and rehabilitation measures for the offender.
