الملخص:
تعتبر المسؤولية الدولية جزء لا يتجزأ من أي نظام قانوني بل أن فعالية تلك الأنظمة القانونية تتوقف على مدى نضوج قواعد المسؤولية فيه فهي أداة تطور للقانون الدولي بما تكفله من ضمانات ضد مخالفة الالتزامات القانونية فعند قيام دولة أو أي شخص من أشخاص القانون الدولي بعمل مخالف للالتزامات الدولية فتصبح حينئذ ملزمة بإصلاح الأضرار الناجمة عن تلك التصرفات.
ولقيام المسؤولية الدولية يجب أن تتوافر عناصرها، وهي الخطأ من جانب الشخص الدولي، والضرر الذي يسببه نشاطه للدول الأخرى بالإضافة إلى علاقة السببية بين التصرف غير المشروع والضرر الذي نتج عن تصرفه أي قيام علاقة مباشرة بين الخطأ والضرر، وعليه لا مسؤولية بدون علاقة سببية وهذا العنصر الأخير قد يتوفر دون وجود خطأ أي علاقة السببية منفصلة عن الخطأ لكن متصلة بالضرر.
ومن أهم المشاكل التي يعاني منها عالم اليوم النفايات الالكترونية، والتي تعد من أهم المظاهر السلبية للتقدم التكنولوجي والصناعي الحاصل بسبب ما تفرزه من مواد سامة وخطرة ناهيك عن كون تلك المشكلة لا يحدها مكان، ولا زمان، ولا إنسان؛ لذلك استشعر المجتمع الدولي خطر هذه الظاهرة فتكاتفت الجهود لمواجهتها، وعقدت الاتفاقيات والمؤتمرات على الصعيدين الدولي والاقليمي.
وبما أنه أصبح من الضروري مواجهتها لذلك تطورت على غرارها قواعد المسؤولية الدولية التي هي الأساس للنظام القانوني الدولي لتواكب هذا التطور وتواجه مشاكله حتى لا يبقى من تسبب بتلك الأضرار بمنأى عن المسؤولية بحجة أن الفعل الذي قام به قد يكون مشروعاً، ولا يخالف قواعد القانون الدولي ففي حال ثبتت المسؤولية الدولية أيما كان أساسها يترتب على المسؤول واجب التعويض بوصفه أثراً لثبوتها.

Abstract:
International responsibility is considered an integral part of any legal system. Indeed, the effectiveness of these legal systems depends on the maturity of the rules of responsibility in it. It is a tool for the development of international law, with the guarantees it guarantees against violating legal obligations. When a state or any person of international law commits an act that violates international obligations. It then becomes obligated to repair the damage resulting from those actions.
In order for international responsibility to exist, its elements must be present, which are the error on the part of the international person, the damage that his activity causes to other countries, in addition to the causal relationship between the illegal behavior and the damage that resulted from his behavior, that is, the establishment of a direct relationship between the error and the damage, and therefore there is no responsibility without a causal relationship and this element. The latter may exist without the existence of a fault, i.e. a causal relationship separate from the fault but connected to the damage.
One of the most important problems facing the world today is electronic waste, which is considered one of the most important negative manifestations of technological and industrial progress due to the toxic and dangerous materials it secretes, not to mention the fact that this problem is not limited by place, time, or person. Therefore, the international community sensed the danger of this phenomenon and joined efforts to confront it, and agreements and conferences were held at the international and regional levels.
Since it has become necessary to confront it, the rules of international liability, which are the basis of the international legal system, have developed to keep pace with this development and confront its problems so that the person who caused these damages does not remain immune from responsibility on the pretext that the act he committed may be legitimate and does not violate the rules of international law. If international liability is proven, whatever its basis, the official has a duty to compensate as a consequence of its establishment.
