الملخص:
تناقش هذه المقالة البحثية مقارنة الفروق والتشابهات بين الفرض والواجب. هدف البحث هو إيجاد حلول للمشكلات الناتجة عن الاختلافات النظرية بين المصطلحات الفقهية في ضوء هذه المصطلحات. وتعتبر هذه المسألة ذات أهمية خاصة لأن معرفة الفروق والتشابهات بين الفرض والواجب تؤثر على الأحكام الشرعية. تظهر نتائج البحث أن الاختلاف بين الفقهاء الحنفية والفقهاء الجمهور في الفرق بين الفرض والواجب هو اختلاف لفظي. وفقًا لعلماء الجمهور، لا يوجد فرق بين المصطلحين، بينما يخصص فقهاء الحنفية مصطلح “الفرض” للأحكام التي تثبت بالدليل القطعي، و”الواجب” للأحكام التي تثبت بالدليل الظني. استخدم هذا البحث المنهج الكتابي والتحليلي.

Abstract:
This research paper discusses the comparison between the differences and similarities between Fard and Wajib. The aim of the research is to find solutions to the theoretical problems arising from the differences in the usage of these legal terms. This issue is particularly important because understanding the differences and similarities between Fard and Wajib impacts the legal rulings. The results of the research show that the difference between Hanafi scholars and the majority scholars regarding the distinction between Fard and Wajib is a matter of terminology. According to the majority scholars, there is no difference between the two terms, while Hanafi scholars use the term “Fard” for rulings that are proven by an unequivocal (Qat’i) evidence, and “Wajib” for rulings that are proven by a probable (Zanni) evidence. This research utilizes the textual and analytical methodology.
