الملخص:
يهدف هذا البحث إلى دراسة طبيعة خطاب المفتي وتحليل دوره في المجتمع العربي المعاصر، مع التركيز على مدى تأثير الفتوى في تشكيل الرأي العام. وينطلق البحث من فرضية مفادها أن خطاب المفتي بات من الأدوات المركزية في توجيه الوعي الجمعي، في ظل تحوّل اهتمام الرأي العام من المؤسسة التعليمية إلى المرجع الديني. كما يسعى إلى إبراز أهمية تحقيق التوازن بين المرجعية النصية للفتوى ومتطلبات الواقع المعاصر، وبيان آليات الجمع بين التمسك بالنصوص القطعية والاستجابة للتحولات الاجتماعية والثقافية دون الإخلال بروح الشريعة ومقاصدها. وتتمحور إشكالية البحث حول مدى قدرة صناعة الفتوى على تجاوز الإشكالات والتحديات التي يواجهها المجتمع العربي، وحدود انخراط الاجتهاد الفقهي في المسار الأخلاقي بما ينسجم مع واقع الحياة في ظل الأزمات الإنسانية المعاصرة. والضغوط الاجتماعية والاقتصادية. والإشكالية التي نطرحها إلى أيّ حدّ تتحرّك اليوم عمليّة الاجتهاد في المسار الأخلاقي وتتماشى وواقع الحياة في ظلّ الأزمات الإنسانيّة المعاصرة؟

Summary :
This study aims to examine the nature of the mufti’s discourse and analyze its role in contemporary Arab society, with particular emphasis on the impact of fatwas on shaping public opinion. The research is grounded in the assumption that the mufti’s discourse has become a central instrument in guiding collective consciousness, especially as public attention has shifted from educational institutions toward religious authority. The study also seeks to highlight the importance of maintaining a balance between the textual foundations of fatwas and the requirements of contemporary reality, and to clarify the mechanisms through which adherence to definitive religious texts can be reconciled with responsiveness to social and cultural transformations, without compromising the spirit and objectives of Islamic law.
The research problem centers on the extent to which the process of issuing fatwas is capable of overcoming the challenges and dilemmas facing Arab society, as well as the limits of juristic reasoning (ijtihād) in engaging with the ethical dimension in a manner consistent with lived reality amid contemporary humanitarian crises and ongoing social and economic pressures. Accordingly, the central question posed is: to what extent does the process of ijtihād today operate within an ethical framework that aligns with the realities of life in the context of contemporary humanitarian crises?
