الملخص
يتناول هذا البحث موضوع الإعجاز التشريعي في آيات القصاص باعتباره أحد مظاهر الإعجاز القرآني البارزة التي أظهرت دقة التشريع الإسلامي وعدالته وشموله لمقاصد الشريعة. ويهدف البحث إلى بيان الكيفية التي شرّع بها القرآن الكريم القصاص بما يحقق التوازن بين العدالة والرحمة، ويصون النفس البشرية من الاعتداء، ويقيم الأمن في المجتمع. وقد اعتمد البحث المنهجين التحليلي والاستنباطي في دراسة النصوص القرآنية ذات الصلة، وتحليل أبعادها التشريعية والمقاصدية. وتوصل البحث إلى أن تشريع القصاص يمثل نموذجاً فريداً من الإعجاز التشريعي، إذ جمع بين العدل الإلهي والرحمة الإنسانية، وحقق مقاصد الشريعة في حفظ النفس وردع الجريمة وتحقيق السلم الاجتماعي. كما أظهر البحث أن العدالة والمساواة، وشخصية العقوبة، والعفو والدية، ومنع التجاوز، جميعها تمثل صورًا دقيقة من هذا الإعجاز الرباني، الذي فاق كل النظم الوضعية في تحقيق التوازن بين الحق والرحمة. وختم البحث بعدة توصيات تؤكد أهمية إدراج دراسات الإعجاز التشريعي في المناهج الأكاديمية، وإبراز عدالة هذا التشريع في الخطاب الديني والإعلامي، والدعوة إلى تطبيقه بما يحقق استقرار المجتمعات وعدالة السماء في الأرض.

Abstract
This study addresses the topic of legislative inimitability (iʿjāz tashrīʿī) in the Qur’anic verses concerning qiṣāṣ (retributive justice), as one of the prominent aspects of Qur’anic inimitability that demonstrates the precision, justice, and comprehensiveness of Islamic legislation in fulfilling the higher objectives of Sharia. The research aims to clarify how the Qur’an legislated qiṣāṣ in a way that balances justice and mercy, protects human life from aggression, and establishes security within society. The researcher employed both analytical and deductive methodologies in examining the relevant Qur’anic texts and analyzing their legislative and maqāṣid-based dimensions.
The study concludes that the legislation of qiṣāṣ represents a unique model of legislative inimitability, as it harmoniously combines divine justice with human compassion, achieving the objectives of Sharia in preserving life, deterring crime, and realizing social peace. Furthermore, the research shows that justice and equality, the individuality of punishment, pardon and blood money (diyah), and the prevention of excess all constitute precise manifestations of this divine inimitability—surpassing all man-made legal systems in attaining equilibrium between right and mercy. The study concludes with several recommendations emphasizing the importance of integrating the study of legislative inimitability into academic curricula, highlighting the justice of this legislation in religious and media discourse, and calling for its implementation as a means of achieving societal stability and the realization of divine justice on earth.
