الملخص
يأتي هذا المقال لتجلية مفهوم الذرائع والوسائل ،وتأصيلها بالأدلة الصريحة الصحيحة،وتقسيمها إلى ثلاثة أنواع؛طرفين وواسطة،وبيان اعتماد مذهبنا المالكي على مراعاتها في تحقيق جلب المصالح،ودرئ المفاسد ،واعتباره لتحقيق ذلك ولو بالمآل،فالتصرفات التي ظاهرها الإصلاح وسلامة النية إن أدت بمآلها إلى فساد يسدها بناء على أن درئ المفاسد أولى من جلب المصالح.وقد حقق المذهب بهذه القاعدة سد كثير من المفاسد ،وساير بها الحوادث المتجددة والنوازل الطارئة،وواكب بها الواقع المتغير لأخلاق الأمم،وعوائد الناس؛وللوقوف على أهمية هذه القاعدة؛أوردنا تطبيقات عملية شاهدة على مراعاة المذهب المالكي لسد المفاسد ولو بالمآل،والبعد المقاصدي في فروعه الاجتهادية.
وإعمال الذرائع مطرد في كل أبواب الفقه ،وقد اقتصر المقال على تطبيقاته في باب المعاملات وما له صلة بها.

Abstract:
This article aims to clarify the concept of means and methods, establish them with clear and authentic evidence, and categorize them into three types: two extremes and a middle ground. It also explains how the Maliki school of thought relies on considering these means and methods to achieve benefits and prevent harm, even if the outcome is not immediately apparent. If actions that appear to be corrective and well-intentioned ultimately lead to corruption, they are prohibited based on the principle that preventing harm takes precedence over achieving benefits.
The Maliki school has achieved great success in preventing many evils and has kept pace with new developments and emerging issues, adapting to the changing realities of nations’ morals and customs. To highlight the importance of this principle, the article provides practical examples that demonstrate the Maliki school’s consideration of preventing harm, even if it is not immediately apparent, and its focus on the ultimate goals in its jurisprudential branches.
The application of means and methods is consistent across all areas of jurisprudence, but this article focuses specifically on its applications in the field of financial transactions.
